Terms of Service

1. Service
NYC Property Audit compiles publicly-available New York City records into readable reports. The service is delivered on an “as-is” basis and data accuracy depends on the upstream agencies (HPD, DOB, OATH, DOF, FEMA, NYPD, DOE, ACRIS, PLUTO).
2. Not professional advice
Reports are informational only and do not constitute legal, financial, tax, or real-estate advice. Consult a licensed attorney, broker, or inspector before entering into any transaction.
3. Payment & refunds
Payments are processed by Stripe. Refund eligibility is governed by our Refund Policy (/legal/refund), which is incorporated by reference into these Terms.
3a. Pro Monthly subscription & auto-renewal
The Pro Monthly plan is a recurring subscription that bills $99.99 USD per month, automatically renewing on the same day of each month until you cancel. By purchasing Pro Monthly you authorize us (through Stripe) to charge your payment method the subscription fee plus any applicable taxes on each renewal date until you cancel. You may cancel at any time from your account page or directly through the Stripe Customer Portal — cancellation takes effect at the end of the then-current billing period, after which no further charges will be made. We do not offer pro-rated refunds for partial billing periods. If your card payment fails, your subscription may be paused or canceled per our payment processor's standard retry policy.
4. Acceptable use
Automated scraping, resale, or redistribution of reports is prohibited. Access may be revoked for abuse.
5. Limitation of liability
To the maximum extent permitted by law, liability for any claim arising out of use of the service is limited to the amount paid for the report giving rise to the claim.
6. Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. Exclusive venue for any dispute is the state or federal courts located in New York County, New York.
7. Indemnification
You agree to indemnify, defend, and hold harmless NYC Property Audit, its officers, employees, and contractors from any third-party claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your use of a report as evidence or basis for any communication, dispute, negotiation, or legal action against a landlord, seller, broker, tenant, agent, contractor, or other third party; (b) your republication or onward distribution of report content; or (c) your breach of these Terms. We reserve the right to assume the exclusive defense of any matter for which you owe indemnification, in which case you will cooperate with our defense.
8. Dispute resolution & class-action waiver
Any dispute between you and NYC Property Audit arising out of these Terms or your use of the service must be resolved on an individual basis. You and NYC Property Audit each waive the right to participate in or be represented in any class action, collective action, mass arbitration, or representative proceeding against the other. If a court finds this class-action waiver unenforceable as to a particular claim, that claim must be severed and resolved in court — the waiver remains enforceable for all other claims.
